1. Acceptance of Terms
By accessing or using LabSync ("Platform"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service. These terms apply to all visitors, users, and others who access or use the service.
2. Use License & Multi-Tenancy
LabSync operates as a multi-tenant SaaS platform. You are granted a limited, non-exclusive, non-transferable, revocable license to use the platform strictly in accordance with your active subscription plan. Each registered laboratory ("Tenant") is isolated in terms of data and configuration. Exceeding assigned limits — such as user seats, report volumes, or API request quotas — without upgrading your plan may result in a soft-lock or suspension of service.
3. Account Registration
To access the platform, you must register with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Patient Data & Compliance
You act as the Data Controller for all Protected Health Information (PHI) stored via LabSync. We act solely as a Data Processor. It is your responsibility to:
- Obtain informed patient consent prior to storing any sensitive data
- Generate and store diagnostic reports in compliance with applicable local medical regulations
- Comply with HIPAA, DPDPA (India), and any other applicable data protection laws in your jurisdiction
5. Prohibited Uses
You agree not to use the platform to:
- Violate any applicable law or regulation
- Transmit any misleading, false, or fraudulent diagnostic information
- Reverse engineer, decompile, or attempt to extract source code from any part of the service
- Share your account credentials with unauthorized parties
6. Disclaimer of Warranties
The service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 99.9% uptime, we do not warrant that the service will be uninterrupted, timely, secure, or error-free. LabSync reports are tools to assist clinical workflows — all diagnostic interpretations must be independently verified by licensed medical professionals.
7. Limitation of Liability
To the fullest extent permitted by applicable law, LabSync and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this page. Continued use of the service after changes constitutes acceptance of the updated terms.
